California enacts important new employment law legislation ...

The 2012 session of the California Legislature resulted in passage and enactment of several important employment law bills.

Inspection of personnel files

Assembly Bill 2674 addresses the logistical issues regarding inspection of personnel records. Under current California law, Labor Code section 1198.5 grants current employees the right to inspect their own personnel records relating to performance or any grievance involving the employee.

Under the new law, which takes effect Jan. 1, 2013, both current and former employees have the right to inspect their records. Employers must permit the inspection no later than 30 days after receiving a written request. If requested, the employer must provide copies of the records at a charge not to exceed the actual cost of reproduction (and postage, if requested by a former employee).
