New healthcare exchange rules issued for states
WASHINGTON (Reuters) - The Obama administration on Monday released broad new operating rules for state-run health insurance exchanges, which form a key part of the 2010 federal healthcare reform law that will face landmark Supreme Court hearings in just two weeks.
The long-awaited regulations, released by the Department of Health and Human Services, are intended to provide state lawmakers and officials flexibility on federal deadlines as they meet the complex task of building state and regional insurance markets before a January 1, 2014, deadline.
In a 642-page final rule, the government provides guidance on how states should establish exchanges, qualify health plans for participation and determine the eligibility of both individuals and small business that want to use exchanges to provide health coverage to their employees.
Industry and consumer groups welcomed the regulations, saying they provided states with the flexibility necessary to meet consumer needs for choice and quality protections. They also said the regulations shift policy focus to the state level, where the new rules must be implemented.
State exchanges are part of a two-pronged effort to provide health coverage for about 30 million uninsured Americans under the Patient Protection and Affordable Care Act, which also calls for a dramatic expansion of the joint federal-state Medicaid program for the poor.
The exchanges amount to federally subsidized state-run insurance markets designed to operate like Amazon.com by providing consumers Web-based access to affordable health plans that meet minimum quality standards.
But how state exchanges perform could be determined by a high profile Supreme Court case in which 26 states and a business group claim healthcare reform should be overturned as unconstitutional because it requires most adults to buy private health insurance or pay a penalty.
That requirement, known as the individual mandate, is intended to limit insurance risk in the exchanges by ensuring that younger, healthier adults participate. Otherwise, analysts say, the exchanges could become dominated by older, sicker adults, which would mean higher costs and fewer participating plans.
The Supreme Court will hear oral arguments March 26-28 and is expected to issue a ruling by July 1.
Many states have delayed participation until the ruling is out. About 33 states have received federal grant money to help set up exchanges.
The new rule retains a January 1, 2013, deadline for state exchanges to meet federal standards but also would allow states to qualify after January 1 if they can prove their exchanges will be ready to offer open enrollment by October 1, 2013.
The federal government will establish its own exchanges in states that fail to meet standards in time.
The administration is still working on a national regulation to establish essential health benefits that insurance plans must provide to participate in the exchanges.
Mike Russo, policy analyst at the public interest group US PIRG, said the new rules give states substantial leeway in establishing exchanges. But he called on state governments to exceed minimum requirements to negotiate on rates and coverage on behalf of consumers.
The insurance group America's Health Insurance Plans said it would be important to avoid duplicating existing state laws as exchanges develop, warning that duplication would add to complexity and increase costs for consumers.

ENGLEWOOD, Colo. (AP) ? Satellite TV provider Dish Network Corp. has completed its purchase of two satellite operators whose wireless licenses it hopes to use to offer broadband access that can help it compete better with cable TV and phone companies.
Cable and phone companies are able to offer customers packaged plans that include TV channels and Internet access services. Satellite companies cannot do so as well because satellites can't provide Internet services to many households, and speeds are slower.
Dish wants to get around that by building a network based on cell towers on the ground and using wireless spectrum ceded by the two satellite operators, which Dish agreed to buy out of bankruptcy last year.
DBSD North America Inc. and TerreStar Networks Inc. both offer satellite-based wireless services and have authority to operate ground-based services as a backup.
The Federal Communications Commission approved the transfer of wireless licenses to Dish this month, but it deferred decisions on whether Dish could use the spectrum more broadly to offer broadband service that is primarily ground based. For now, devices using the spectrum must be able to access satellite signals as well. That excludes the types of smartphones and tablet computers popular today.
The FCC tries to promote the expansion of wireless broadband services, but it recently decided to kill a similar proposal from a Virginia company called LightSquared after tests showed it would in some cases jam personal-navigation and other GPS devices. Dish has said that its signals won't cause similar interference because its network would be using different frequencies.
Dish said Monday that it has invested more than $3 billion to secure licenses for its proposed network, including the costs of buying assets from the two companies. It said it looks forward to working with the FCC.
Dish, which is based in Englewood, Colo., also said it will start looking for ways to improve handsets that can use the DBSD and TerreStar spectrum today "while exploring its options for a broader market entry."
Dish added a net 22,000 satellite TV subscribers in the last three months of 2011 after posting losses for most quarters in the past two years. It ended the year with 14 million subscribers to keep its position as the third-largest provider of paid TV signals to U.S. households, behind DirecTV Group Inc. and Comcast Corp.
Dish's stock fell 36 cents, or 1.1 percent, to close at $31.10 Monday.

And when Santorum was informed that an aide to Romney had said it would take an act of God for any other candidate to amass a majority of convention delegates, Santorum responded heatedly. "What won't they resort to, to try to bully their way through this race?" he said in Lenexa, Kan. "If the governor now thinks he's now ordained by God to win, then let's just have it out."
One day after Super Tuesday, Romney's campaign circulated a memo making the case that his six victories on a single night had increased his delegate lead to a point that it was increasingly hard for any of his rivals to catch up. And they were hurting the party by continuing to try, it suggested.
"As Gov. Romney's opponents attempt to ignore the basic principles of math, the only person's odds of winning they are increasing are President Barack Obama's," it said.
Romney didn't go that far in an interview, and he stopped short of a flat prediction that he would achieve his goal of a pre-convention delegate majority. "We think that will get done before the convention, but one thing I can tell you for sure is there's not going to be some brokered convention where some new person comes in and becomes the nominee," he said on CNBC's "Squawk Box." ''It's going to be one of the four people that are still running."
After Super Tuesday, Romney has 419 delegates overall, more than his three rivals combined. Santorum is second with 178, Gingrich has 107 and Paul has 47. It takes 1,144 to win the nomination.
While Romney clearly would like all his opponents to drop out, the departure of just one ? either Santorum or Gingrich ? might be less welcome. The two often divide the anti-Romney vote and enable him to win contests he might otherwise lose. In Ohio, the marquee matchup on Tuesday, Romney edged Santorum by a little more than 10,000 votes out of 1.2 million cast. Gingrich drew about 175,000 votes and Ron Paul 111,000.
Gingrich and Santorum both argue that despite Romney's financial and organization advantages, he is a latecomer to conservative causes, plagued by inconsistencies in his record and unable to articulate significant differences with Obama.
Earlier this week, Romney abruptly abandoned a position he has held since he ran for governor to link increases in the federal minimum wage to rises in inflation. He had reaffirmed it as recently as last month, telling reporters aboard his campaign jet, "I haven't changed my thoughts on that." But Santorum and Gingrich hold opposing views, as do Republican business allies, and on Tuesday, Romney said on CNBC, "There's probably not a need to raise the minimum wage."
In a post-Super Tuesday interview, Romney also said there is no current way of proving that his proposed tax cuts wouldn't raise the deficits, "because those kind of details have to be worked out with Congress and we have a wide array of options."
He has called for a 20 percent reduction across the board in personal income tax rates, and says he will recommend curbing some of the existing tax breaks that wealthier taxpayers currently enjoy. Asked what level of income would qualify as wealthy, he sidestepped.
"What I'll look at is the various cohorts, the top 5%, the top 10%, the top 25%, we'll look across the code at the various categories and see if they're continuing to pay the approximate share that they've paid in the past under the current system," he said.
"It's important that the great majority of Americans don't see an increase in their tax share," he added.
Romney spent the day in Massachusetts after sleeping at home for the first time in weeks, a result of a nominating campaign that has gone on longer than any in recent years.
Santorum campaigned in Mississippi and in Kansas, which holds caucuses next Saturday with 40 delegates at stake. Wyoming, with 12 delegates, is also on the calendar, as are the Virgin Islands, Guam and the Northern Marianna Islands, with 6 apiece. Mississippi and Alabama have primaries on Tuesday.
The former Pennsylvania senator won three Super Tuesday states, reviving his campaign after a recent string of setbacks, and he issued a fresh appeal for campaign funds to compete with Romney.
"We've proven we can win this race. ... I think this is because Americans are looking for a blue-collar Reagan conservative ? not a Massachusetts moderate," the appeal said.
Next Tuesday's calendar runs from primaries in Alabama, 47 delegates, and Mississippi, 37 delegates, to caucuses in Hawaii, 17, and American Samoa, 6.
Santorum urged Mississippi Republicans to vote for him and, in essence, drive Gingrich from the race.
"If you deliver a victory for us on Tuesday, you will make this a two-person race," Santorum said at a small business in Tupelo, Miss. "And once it's a two-person race, the conservative will be the nominee. You can change it all, Mississippi."
The Romney campaign's decision to begin advertising in Alabama suggested a competitive race, as did a private poll and Gingrich's decision to skip a trip to Kansas to focus his efforts on the Alabama and Mississippi primaries. A Gingrich aide said the former House speaker must win both next week to justify his place in the race.
In Montgomery, Ala., he criticized both Romney and Santorum. He said the former is a moderate in the mold of Bob Dole and John McCain, both of whom led the party to defeats in presidential elections.
As for Santorum, he said, "I am not going to Washington to be a good team member. I'm going to Washington to change Washington." That was a reference to the former senator's recent debate statement that he voted for President George W. Bush's No Child Left Behind Education bill even though he opposed it, because he wanted to help the GOP team.

Bellator fighter off Friday?s card, wanted by police
Eric Oria was supposed to show up at Bellator's weigh-ins on Thursday to officially weigh in for his first professional fight in Hammond, Ind. Instead, the Indiana State Police showed, looking to take Oria into custody.
The Northwest Indiana Times reported Oria missed Thursday's weigh-ins. Bellator CEO Bjorn Rebney said Oria scratched from the card before weigh-ins because of "physical problems."
Oria had an outstanding warrant on a charge of criminal recklessness. He was scheduled to fight Lance Surma on the show's undercard. After two amateur fights in Hammond, he was set to make his pro debut in the same town as his other fights.

United-Continental computer hiccups affect some fliers

UPDATED 12:15 p.m. PT: Customers of United Airlines?saw improved?service on Sunday?as the airline?worked through technology glitches during its combination of the United and Continental Airlines reservation systems.
On Saturday, United?adopted the reservation platform of the former Continental Airlines after the companies merged to form the world's largest airline, now known as United Airlines and owned by United Continental Holdings.
But after spending months preparing for the change ? including training about 15,000 employees on the new software ? United said on Sunday that technical issues had flared up at airports across the system, causing delays.
In particular, problems with the company's airport check-in kiosks meant customers had instead to line up to see service agents, spokeswoman Megan McCarthy said.
"We did have some issues with our kiosks and at times that slowed the check-in process," McCarthy said, adding that the airline's performance had improved by Sunday morning as the company installed upgrades to the kiosks.
About 75.5 percent of United's mainline flights were on time ? arriving within 14 minutes of their scheduled slot ? on Sunday morning, as were about 87.1 percent of its Express flights, according to McCarthy. "Employees are working hard to take care of our customers," she said.
Original story: In a final step of its merger, United-Continental on Saturday performed a massive procedure consolidating two IT systems into one, a process called a ?cutover.? The transition?has gone relatively smoothly, though some fliers have been affected by missed connections and late departures and arrivals.

In an e-mail to msnbc.com, United Airlines spokesperson Rahsaan Johnson said one system is now supporting the carrier. "The system conversion involves moving millions of reservations and re-establishing numerous communications links. The vast majority of this work is going well, and we are resolving technical issues that we are identifying during this process," he said.
?As a letter grade, I give them a B-,? said Joe Brancatelli, frequent flier and publisher of business-travel newsletter JoeSentMe. Most problems, he said, have been reported at pre-merger United hubs such as Dulles International in Washington and O'Hare International in Chicago. Former Continental hubs, he observed, have not had as many problems.
As for the delays at Dulles and O'Hare, Johnson said the airline is working "to speed up airport kiosks, which at times have slowed check-in," but added "most of our flights have either departed on time or within 30 minutes of the scheduled departure time.
As of 5 p.m. ET, United's on-time percentage for departures out of O'Hare was at 16 percent, according to Flightstats.com. Out of 83 tracked departures, one was canceled, 28 were delayed between 15 and 30 minutes, 20 delayed between 30 and 45 minutes and 21 were delayed more than 45 minutes. By comparison, American Airlines' on-time percentage out of O'Hare was 85 percent.
?Barring an absolute meltdown, the electronic side has gone as well as expected,? Brancatelli told msnbc.com. ?In fairness, I don?t see the gigantic problems we?ve seen with other cutovers.?
Recent history is littered with cutovers that didn?t go quite as planned. Perhaps the most infamous snafu took place in 2007 when US Airways tried to integrate the systems of merger partner America West. The result? Out-of-order kiosks, long lines, flight delays and lots of inconvenienced and angry customers.
More recently, Virgin America and?Cathay Pacific?have suffered IT-migration meltdowns that impacted travelers? ability to manage reservations, access mileage plan accounts or talk to a reservation agent.
As for United's cutover, ?people haven?t lost a seat or not been upgraded, but it?s not running as smoothly as it should,? Brancatelli said, adding that problems will be fixed in the days ahead, but said the issue today is moving people through the system.
Continental's last flight, 1267, departed from Phoenix at 11:59 p.m. PST on Friday and arrived on-time in Cleveland as United 1267 on Saturday morning.
The airline will stop using Continental's "CO" code. That means no more Continental Airlines tickets, or flights ? even though the Continental name is still painted on some planes.
If you?re traveling today, Brancatelli urges carrying on your luggage if you can, printing out everything, leaving for the airport early and allowing plenty of time, and if you?re not flying over the next few days, staying off United.com.
?Don?t obsess that all the miles you?ve rode haven?t caught up. They will. Today is about people traveling now,? he said.
United and Continental have gone to great lengths to lay the groundwork for a successful transition. Earlier this week, United's Johnson said the carriers?conducted four dress rehearsals, successfully migrating the data from United?s Apollo-based system to Continental?s SHARES-based one.
?As in any dress rehearsal, we figured out potential issues that might arise, fixed them and developed procedures in case they arise again,? he said.
The last flight will mark the completion of the takeover of Continental by United. NBC's Brian Williams reports.

Whoops! Ian McCall/Demetrious Johnson bout should have been a draw
In the first ever UFC 125-lb. match, an error by the athletic commission in Australia screwed up the result. Ian McCall and Demetrious Johnson's bout should have been scored as a draw, and their fight should have gone to a fourth, sudden-death round.
After the fight, MMA Junkie's John Morgan reported that the score announced was not the score written on the judges cards he received. During the post-fight press conference, UFC president Dana White reported that the fight was actually scored as a majority draw. By the rules of the flyweight tournament, it should have gone to a fourth and decisive round, but the error was discovered too late.
"Controversy has stuck to us like glue. Human error happens. Johnson-McCall was a draw. Fight was supposed to go to a fourth round. The commission has taken responsibility," White said.
The two will rematch to decide who will take on Joseph Benavidez, the other flyweight tournament winner at UFC on FX 2 on Friday night. For McCall, it's another chance to give the fans a show.
"We get to fight again. I feel vindicated," McCall said.
Johnson was looking forward to fight Benavidez for the promotion's first flyweight title, but now the process will take longer.
"I thought I had the victory, and it sucks because it prolongs stuff," Johnson said.
One consolation for Johnson and McCall is that they won the $50,000 Fight of the Night bonus, and they both received their win bonuses. They will now have to schedule another fight to see when they can get a step closer to the championship belt.
